To be honest, I don't see a solid legal theory for lawsuits against anyone but the gun's manufacturer. For example, automatic weapons are illegal in the US. If the gunman purchased a semi-automatic weapon and illegally converted it to an automatic weapon, the manufacture might face legal liability if there is an easy and relatively inexpensive way to make the weapon so that it cannot be converted from semi-automatic to automatic.
