HEADLINE: Pollard barred from SA T20 league as WICB imposes NOC levy

Kieron Pollard, the West Indies allrounder, has been denied a No-Objection Certificate to compete in South Africa's domestic T20 league, after the West Indies Cricket Board made the unprecedented move of levying 20% of the contract fee on any Caribbean player wishing to participate in an overseas T20 tournament.

Pollard, who signed a two-year contract last season with Cape Cobras, was informed of the WICB decision on November 3 by the board's chief executive officer Michael Muirhead in an emailed letter. He is currently still in Trinidad, with the tournament due to get underway on November 11.

Muirhead called the move a "policy" decision, taken by the WICB board of directors. He also said that the WICB had notified all the ICC Full Member boards of this decision.

"The WICB will levy a charge for the granting of an NOC for West Indian cricketers seeking a release to participate in Leagues outside the jurisdiction of the West Indies," Muirhead informed Pollard in the email, which has been accessed by ESPNcricinfo. "This will be an amount equivalent to 20% of the player fee (as defined in the player contract) that is actually paid to the relevant player."

How do you describe lose them? If they are needed and are contracted it is completely different. When non contracted players go out and use their talent what is the problem?


Pollard, Sammy, Bravo, Gayle, Simmons, Rampaul all have been discarded in no uncertain terms.

If a WICB contract pays a player $ 150,000 plus match fees and totals $ 300,000 how can the WICB refuse a noc to players whose IPL, Big Bash league and or other T20 contracts are worth $ 1 million?

Does the WICB guarantee players continued "employment" if they don't make the team after the end of a one year contract ?

You did not read the Cricinfo article.

The articles says it was the Cricket South Africa Board that needs to agree to the 20% that the WICB demands first before the WICB will offer Pollard the NOC. Its not Pollard's fault he is not getting the NOC, its the WICB's request to CSA that was rejected.

All of you really bad mind and think its the players that are doing all the 'whoring'!!!!

CSA already had a contract arrangement with Pollard, its the WICB that wants to change the contract terms by making that demand on the CSA.

A change in structure the WICB proposes like this must be done at a higher level, with FICA and ICC involvement, especially if the WICB wants to make this universal for WIndies players outside the WICB and for international players playing in the West Indies. They can't just vraps and drop this now.

Its really poor for commentators to be blaming players for this current issue. All weight should be on the WICB.

The money will still come from Pollard's purse. They are just asking CSA to now deduct and forward to them 20% instead of the previous 10. CSA has nothing to loose here. Pollard still has to agree with CSA to the new changes in his contract...

So why then did CSA decline? They do have something to loose. CSA has a contract with the player. If the 20% is coming from the player then Pollard has to agree to the change as well and then Pollard can sue for breech of contract.

That's exactly what the WICB wants to happen... let everything be blamed on the player. The WICB is being very vindictive. They can't just come with this change now. It needed to be done higher up and a long time ago.

Bossman, if Pollard agrees to the 20% levee, he gets his NOC with the 20% deduction written in it. He gives that to RSA and they give him his contract and deduct the 20% and forward it to the WICB. RSA won't give him a contract unless he get his NOC. So Pollard can refuse to give the 20% and stay home and adjust his diaper budget. Or he can agree to the 20% and collect the other 80% and fight the 20% fee otherwise.

I assume they will deduct 20% from each payment he receives over the life of the agreement or until he needs a new NOC. Not sure if they are required to renew their NOC every year. In that case they can't recoup anything from payments he received in the past but going forward they will collect.

While we do not wish to act in restraint of trade, we must seek a balance to ensure that there is fair and adequate compensation for the investment made in the players. What WICB seeks is some compensation to recognize the investment made into players, an investment from which another Full Member is benefitting.

WICB understands that this policy decision may result in reciprocal agreements from other Full Member boards for obtaining NOCs for their players, but we view this approach as necessary to preserve the best interests of West Indies cricket at both domestic and international levels. It is our expectation too, that the accumulation of these fees will facilitate the offer of contracts to additional players

You missed the point (which has later come out more explicitly) that the WICB asked the boards to pay the fee and not the player. Great that the CSA and CA disagrees. WICB doing things the wrong way. So the WICB (and not the CPL) paying the fees for internationals in the CPL !!! LOL. You sure the CPL would want to rework their 20 year steal of a deal contract with the WICB if WICB demands that the CPL now pay those fees? And then let the CPL sue the WICB? Or those fees should just be passed on to the international player in their renewed yearly contracts?

The WICB used this whole saga to push their point. Looking back it was their strategy all along to give the NOC but create dialogue as well. They apparently didn't mind looking a bit greedy in the process.

IS THERE ACTUAL PROOF THAT THE WICBC

DEVELOPED POLLARD SKILLS IN THE

SHORTEST VERSION OF THE GAME ??????

I do not recall that happening , that
being the case , the WICBC is not
entitled to one cent . The WICBC needs to provide , concrete & DETAILED evidence that it developed
Pollard & Other Players talents in
this version of the game .

The initial reporting around this issue was not very clear and I like many others thought that that this was a tax on Pollard's money.

But I do think that WICB have a legit case to request such a payment from cricket boards as they are at a significant disadvantage. Whether or not they could articulate it into some sort of policy is yet to be seen.

1 - Who is the sole entity/body that is authorised by the ICC to organize cricket in the caribbean and north america?

2 - Is the TTCB a member association of the WICB?

3 - Does the WICB provide any funding to any of it's member associations?

4 - If the answer to #3 is affirmative, for what intended purpose are these funds distributed?

5 - Which entity(s) would you say helped to develop Kieron Pollard's skills in the shortest version of the game?

responses when other Countries request levies . In essence :

" WHAT IS GOOD FOR THE GOOSE

IS ALSO GOOD FOR THE GANDER " .

BTW , in this Forum , there is already news that two International Cricket Boards have already rejected the WICBC's request outright .
