HEADLINE: Sarwan wins case against WICB

FORMER West Indies batsman Ramnaresh Sarwan has won a claim against the West Indies Cricket Board (WICB) and is set to be awarded US$161 000.The incident is rooted in a 2010 encounter between Sarwan and then chief executive officer of the WICB Ernest Hilaire. According to evidence presented in court Hilaire wrote a letter to Sarwan following the series against Australia, which questioned the players overall fitness and approach.
Sarwan had been injured in the first Test and had played the series with an injury.
“While this letter is not intended to highlight specific incidents, we hope that you take our concern as a statement of our desire for a higher level of commitment and application from you as a contracted player and a member of the West Indies cricket team,” the document stated.
According to reports when the player called Hilaire to clarify the contents of the document he did not receive a valid response.
“Dr Hilaire still refused to let Mr Sarwan know what he meant by his words in his letter and, further, stated that ‘if I don’t change my attitude, my career would end’, and then he hung up the phone,” said Seenath Jairam the arbitrator, in his final judgement.

is precisely why the WICBC must be dissolved . The people in the WICBC
clearly have too much power .
That is precisely why they are hugging up their 1927 Structure . They do not want to come into the 21st. century , or adhere to transparency & Good Governance .
The commissioning of all those Reports were & are merely stalling
Tactics , designed to ensure that
their Power remains intact .
Yet their Supporters are blindly supporting them , ignoring the fact
that they are supporting a Regime , that cares not one whit about the
legacy of our Great Teams .

Those were the good old days when players won arbitrations no matter what because an incompetent WICB agreed to an unworkable MOU where WIPA had to give its approval before a WICB board member could fart

Ahha!! That's a much broader perspective of things.
And the MOU/CBA in its lopsided construct was eventually destroyed after this, thus removing WIPA's fangs.

Ramnaresh Sarwan, the West Indies batsman who has not played since June 2011, has won his case against the West Indies Cricket Board (WICB) over comments made about his fitness and has been awarded US Dollars 1,61,000 in damages. The matter was heard in arbitration. Though the verdict was delivered earlier in March 2016, the details of the ruling have only emerged in the last week.
Reportedly, one reason being cited is that West Indies Players’ Association (WIPA) wanted to make certain the players had got the money in hand.
Sarwan had lodged the appeal, in conjunction with WIPA against WICB in March 2011 for unfairly questioning in public his fitness and attitude. This, he said, effectively cost him not only a central contract for the 2010-11 season but also damaged his “reputation as a professional cricketer” and “sullied his career as an international cricketer.”

What is more instructive is that Sarwan won the case arguing basically the points that ended his career.

And he did not attended the hearing...to defang WIPA.
Justice Rahim: Mr. Hamel-Smith, is it your understanding that Mr. Hall is going to be called first?
Mr. Hamel-Smith: No. We got a message that Mr. Hall is not going to be attending to give evidence. My understanding is that we go straight to Mr. Ramnarine. Is that not right?
