Two Black men arrested at Starbucks for not ordering anything.

Two black men were arrested after they tried to use the bathroom in a Philadelphia Starbucks without ordering anything as they waited for a friend.

The display of police force on Thursday shocked the coffee shop customers who defended the arrested pair saying 'they didn't do anything'.

The moment was caught on a video by a customer at the 18th and Spruce Street Starbucks.

It must be must be noted that it was other white patronS who were very vocal about the Police actions.

It also shows that the Police were acting in its historical role as agents of the predominant white power structure. Handcuffing the individuals and putting them in jail for a number of hours can only be seen as an extreme act.

Even the Starbucks CEO is now calling it "a reprehensible outcome".

"The video shot by customers is very hard to watch and the actions in it are not representative of our Starbucks mission and values," Johnson said in his statement released late Saturday. "Creating an environment that is both safe and welcoming for everyone is paramount for every store. Regretfully, our practices and training led to a bad outcome - the basis for the call to the Philadelphia police department was wrong. Our store manager never intended for these men to be arrested and this should never have escalated as it did."

This was my strategy to get to use a bathroom...early AMs, I am usually in a certain neighborhood. At the mom & pops restaurant, nearby, I would, periodically, go in, buy a small coffee & give it a needy person on the street. Now, anytime I need to use their bathroom - no problem!

People get so riled up about every darn thing. These guys were at the restaurant. Didn't order anything. The manager requested that they leave. They refused. The police came and repeatedly asked them to leave and they refused. What gives?

My question is: Why are folks getting all twisted about this? If you were running a business, would you allow people to loiter?

Not every thing is black and white. Some things are very basic.

I remember I was in London in February, first day in the city, I was waiting for a friend, a homeless guy asked me to buy him a coffee, I went inside, ordered him a coffee, we sat down and he drank his coffee and left. It was cold outside so I sat inside for a bit but one of the workers told me to leave. Weird thing, the restaurant (it was a "chippy") was deserted. I pleaded my case, that I actually purchased food from them, but they were adamant and said they'd call security.

Race? Probably, although I didnt pursue it at the time, I didn't feel like spending my first day in London in cuffs or some nonsense. I stood outside, my friend came, she went in to order food. I just glared at the workers (I should have told her to Eff this establishment in retrospect).

If it is true dem fellas was just there hanging out and had no intentions of buying anything then I cant feel sorry for the manager asking them to leave. At that point they should have just left, but instead they said No? twisted

Now I am not sure what was the interaction between them and the police, hopefully the police asked them politely to leave before having to arrest them

Actually I do go to Starbucks...and I do not hang around to see who is hanging around.

My take is not that they were hanging there. It is that they were asked to leave. And they refused to leave. In essence they were loitering. The cops also asked them to leave and they refused. You can't be serious!

And for that matter it can be any color people there. Why is color a factor in this situ???

He will apologize because this issue has taken on racist overtones. And the perception of Starbucks as a racist entity will hurt the bottomline.

It is damage control, and they have the manager as collateral damage. They want to pacify the protesters who were asking that the manager be fired. He quit instead.

This cannot be right if the manager was following company policy. I can see him suing them.

No one threw out anyone. They were asked to leave and they refused to do so. I don’t know if any whites were asked to leave. I don’t know how many whites were there that didn’t buy anything. Do you?

However what we know, as reported, is that the two guys refused repeated requests to leave, based on company policy of not loitering at the location if you haven’t purchased anything. Hence the police were called. And they even disregard the police repeated attempts to get them to leave.

as I cannot understand how people treat coffee this way. I like it like my women, straight and black lol

I know this joint, a few blocks from City Hall in the heart of Downtown Philly.
No doubt there is some race issue but I also feel there is previous experience too with the manager,this being Philly.

I don't believe one can trespass in a public business place.I don't think it is good policy to have such. Many years ago,I managed a McDonalds for a short while
in South Philly and people would come in just to use the bathroom. I allowed them as many cities like Philly and NY don't have many public restrooms
and if you do your thing on the street,you are liable for arrest and it is a felony in some places. A renk subway stop in NYC or Philly can testify to this
where I have seen both men and women relieving themselves.

Being a manager means that one must also exhibit good sense and discretion.
From what I have learnt watching the news,white folks use the spot as a hangout/meeting place too and remain thirsty for latte for up to half an hour and not asked to leave.
That is the racial component;none was ever asked to leave.
For these two black guys to be arrested and finger printed too is not cool.A charge of trespass while waiting for a business associate is much too much.
I can see this Joint being a money loser here in Philly and a closed shop if the 'no toilet,no purchase' policy is not adjusted.Philly folks don't play when they perceive wrong and that aint got no colour smile

In my neck of the woods, it's a given you can come off the street, go into these types of establishments and relieve yourself - no purchase, no bill.

Also, for places like Starbucks, Second Cup and McDonald etc., especially those with free wifi access, it is accepted even offered that you can come in, (may or may not) buy a small coffee, or anything on the menu, and spend many hours on your computer.

But that is my neck of the woods, the USA is another strange animal, where Black Americans are easy prey.

I am not into coffee, except for the occasional cup after a nice dinner at a restaurant. My wife is the real coffee connoisseur and she's not into Starbucks coffee, so, we seldom, if ever, go there.

You have no idea what loitering is.

Loitering is protected, first and foremost, by the 14th Amendment. In 1972 Margaret Papachristou a vagrant in Jacksonville, Florida was arrested for loitering in an establishment. Her lawyers challenged the arrest and charges in court and won. The court found the loitering ordinance for these establishments encouraged arbitrary and erratic arrest, placing "almost unfettered discretion in the hands of the police.

In 1990, the Chicago v. Morales case challenged a city ordinance banning gang members from loitering. This included loitering in such open establishments, the defendents with backing from the ACLU, won.

Then Justice John Paul Stevens wrote in his majority opinion, "The vagueness that dooms this ordinance is not the product of uncertainty about the normal meaning of loitering," (In the words of another Supreme Court Justice, you know it when you see it.

Just recently McDonald's tried to put the loitering tag on senior citizens who out of boredom left home and sat in their restaurants for hours without buying anything and they lost that battle.

Leff Runout alone. He is trolling. We all know he knows this was blatant racism and bias. It has been widely reported by white folks there the treatment the black men received was crude, rude and racist. Other whites were there hanging around for a long time and no one harassed them.

The issue is not if the police overreacted or if the men violated some shop code. The issue is blatant bias, mistreatment and lack of parity across the board. They will get paid bigly.

What difference a day makes. Could it be that the lady was alone? Could it be that she was white? Could it be that the manager was different? Could it be that the manager had experiences which would give him cause to act the way he did? Would it have been different if it was handled differently? Loads of qestions....but I do believe that this is blown way out of proportion because
of race.

An employee said Starbucks company policy was to refuse the use of the bathrooms to non-customers and asked the men to leave, according to Ross. The employee called the police when they refused.

Of course not. Ross is correct only up until they acted without proper training. I have never done so without buying anything, I always make sure to have a coffee in front of me.

I run a business and many a times I have found myself interviewing people in Starbucks. Sometimes I order stuff. Sometimes I don't. I never go into Starbucks with an agenda of ordering vs not ordering. I have always viewed it as a place to go hang out and get stuff done. Ordering is expected but never a requirement and it was never reinforced. It was never an issue because the managers never made it an issue. Other folks in there are doing all sorts of stuff but mostly people mind their business and life goes on. At the end of the day, Starbucks will get paid regardless.

We all know the manager screwed up. The police need training and these men will get paid.

When did you first notice the two men who wound up being arrested at the Starbucks?
I was just sitting there working on my laptop, and I guess I first noticed them when the two first cops — the bike cops — walked in. The girl behind the counter had called 911, apparently, and the cops came and said the guys were “trespassing.” They said we were waiting for somebody, and then the white guy in the video — that’s their family friend they were waiting for — he shows up. And then how did it escalate from there?

Just an update...

2 black men arrested at Starbucks get an apology from police

On Thursday, they also got an apology from Philadelphia Police Commissioner Richard Ross, a black man who at first staunchly defended his officers' handling of the incident.

"I should have said the officers acted within the scope of the law, and not that they didn't do anything wrong," Ross said. "Words are very important."

At a news conference, a somber Ross said he "failed miserably" in addressing the arrests. He said that the issue of race is not lost on him and that he shouldn't be the person making things worse. "Shame on me if, in any way, I've done that," he said.

He also said the police department did not have a policy for dealing for such situations but does now, and it will be released soon.
