Breaking Guyana news - Court of appeal ruling

BREAKING NEWS | In a majority decision this afternoon, the Court of Appeal has ruled that the no confidence vote was NOT VALIDLY passed on December 21, 2018. The three judges ruled 2-1.

Chancellor Yonnette Cummings-Edwards and Justice Dawn Gregory ruled that the threshold required for a No Confidence Motion was 34 votes, not 33. Justice Rishi Persaud provided a dissenting ruling.

This ruling effectively means that the Coalition Government is fully legal, lawful and constitutionally remains in office without any hindrance or questions.

I’m not going to say much about the ruling along the race line (nothing new to Guyana) but I’ll say that its not so bad to delay the PPP taking power once again

Gives time for something better to emerge...I thought that better something was the coalition but the answer is a clear NO

Should any bill or law passed with 33 votes be deemed invalid? Or just important ones.

This ruling by the court of appeal is not valid if we do the PNC math.
3.2 = 1.5
round up 1.5= 2.0
majority is 1 more than 2
therefore majority is 3.0. Since only 2 of the judges ruled in favour then the ruling is not by majority.

Elections are not far off and if the majority of Guyanese believes the opposition should form the new government then so be it.

They said the NCM is held to a higher standard lol mind you these are all their standards and has nothing to do with what is in the constitution. It is pellucidly clear in the wording that the majority is the deciding factor. Not a simple majority nor an absolute majority. Furthermore if that was to be the deciding factor it would have been inserted in the constitution.

In the US Senate the VP votes in the tiebreaker.

If an absolute majority of 65 is 34 how do we calculate the minority? Remember we rounded up 65/2 = 32.5 to 33 for the majority plus 1 = 34 for absolute majority. Do we round down for the minority? If we round up we have a 33 minority cool lol

Hola...don,t be a smart alec..it has to be rounded up and plus 1..if you just round up you then get 32.5 plus 33 which is 65.5 you cannot get .50 in this equation..so please figure it out..
the ruling is correct..because .5 is not a whole

Majority of 65 is 33, 1/2 of 65=32.5 rounded up is 33. Like you went to August school. Where did absolute come from? Certainly nowhere in the constitution rolleyes
