BREAKING NEWS | In a majority decision this afternoon, the Court of Appeal has ruled that the no confidence vote was NOT VALIDLY passed on December 21, 2018. The three judges ruled 2-1.
Chancellor Yonnette Cummings-Edwards and Justice Dawn Gregory ruled that the threshold required for a No Confidence Motion was 34 votes, not 33. Justice Rishi Persaud provided a dissenting ruling.
This ruling effectively means that the Coalition Government is fully legal, lawful and constitutionally remains in office without any hindrance or questions.
Just saw that on Facebook

Im not going to say much about the ruling along the race line (nothing new to Guyana) but Ill say that its not so bad to delay the PPP taking power once again
Gives time for something better to emerge...I thought that better something was the coalition but the answer is a clear NO

You always need a clear set of eyes, usually an outsider
Legal issues interpreted differently.
This is like a boxing match.

Agreed
By the way where did simple and absolute majority come from? Those terms are not in the constitution.
What is majority of 66?

a pack of racist guyanese bloviating in here ...yall ought to be ashamed of yourselves...no wonder people in the caribbean and world at large, have little respect for the remnant racist that can't see past their evil thoughts......it wasn't racism when the CJ ruled for the NC, but it;s racist when the two, learned black judges used their legal knowledge, based on legal precedence , iThe indian judge by right, ruled according to his knowledge, and people respect that, but yall haven't deemed him pro jagdeo or ppp though....
Honestly, thankfully, i've lived with and known some good indian Guyanese, but this particular clique in the backroom, are a sorry set of racists...
Thankfully, Guyana is moving away from our sordid past of institutionalized racism, that jagdeo and the majority of his cabal still embrace ..... in Guyana, the largest growing demographic is "mixed race"...Guyana's history is in the "mixed race"demographic....
Jagdeo presided over the most corrupt time in the history of the caribbean, yet none of you said a word, because many of you and your families/friends benefited immensely from the corruption..... now the gravy train of corrution has dried up, and the drugs that fueled the private sector, has disappeared, yall and the evil businessmen annoyed, and ebginnered the betrayal by the usurper on 21st Decemer...but guess what?....God has a sense of humour....
and yall have the audacity to attack Mr. Grandger as a corrupt man.... granger??? corrupt??.... you had a problem with his race...that's the problem this backroom clique has..... you, like jagdeo, are extremely prejudiced....yes....
God bless you all....
and Guyana could do well without "citizens" like you....

So you're subscribing to jumbie mathematics. Put aside all racist BS.
Does the Guyana constitution say "simple" or "absolute" majority. ?
Should any bill or law passed with 33 votes be deemed invalid? Or just important ones.
In any case APNU AFC is done come next elections.

Wow this is some crazy shit. Leaving out becoming a comedy scene now the upholding of this absolute majority argument is really stirring up trouble along rascist lines. Sad but on the other hand I believe I am gonna challenge the validity of a recent Board election I lost 5 to 4 in a 9 member board. Shoulda been 6 !

What is majority of 66?
If CP had not voted with opposition, 33 votes would not have held the ruling party in power then?

This ruling by the court of appeal is not valid if we do the PNC math.
3.2 = 1.5
round up 1.5= 2.0
majority is 1 more than 2
therefore majority is 3.0. Since only 2 of the judges ruled in favour then the ruling is not by majority.

And I hope the Guyanese people (the opposition party) abide by the rule of law and accept the ruling of the judiciary.
Elections are not far off and if the majority of Guyanese believes the opposition should form the new government then so be it.
I am happy for this ruling.

My only question is how is 33 a majority to govern and pass legislation but not one in a no confidence vote?

They said the NCM is held to a higher standard lol mind you these are all their standards and has nothing to do with what is in the constitution. It is pellucidly clear in the wording that the majority is the deciding factor. Not a simple majority nor an absolute majority. Furthermore if that was to be the deciding factor it would have been inserted in the constitution.
In the US Senate the VP votes in the tiebreaker.

The law must be respected, but the current government will be even "more toothless" now. How will they ever obtain 34 votes to pass anything?

If an absolute majority of 65 is 34 how do we calculate the minority? Remember we rounded up 65/2 = 32.5 to 33 for the majority plus 1 = 34 for absolute majority. Do we round down for the minority? If we round up we have a 33 minority

Hola...don,t be a smart alec..it has to be rounded up and plus 1..if you just round up you then get 32.5 plus 33 which is 65.5 you cannot get .50 in this equation..so please figure it out..
the ruling is correct..because .5 is not a whole
Adios
