Orange Marmalade has other, well-established ways to impose tariffs without Congress. But those powers come with conditions, often including time limits, that would make it harder for Trump to use his start-and-stop approach of raising tariffs and then easing them as a bargaining tool.
For example, one law clearly permits a president to raise tariffs, but only up to 15% and only for a maximum of 150 days. Another authority allows higher tariffs on national security grounds, but it can be applied only to specific industries and requires a Commerce Department investigation.

Listen, we have a Supreme Court and I like the Supreme Court, usually, but some of the things coming out of there are a total disaster. They sit in their robes making decisions that are very unfair to the American worker.
So I’m looking at it very strongly. We’re going to put a major tariff on the Supreme Court. A big, beautiful tariff. And I’m also sending ICE down there to take a look at the whole place. We have to check the papers. We have to see what's going on, because frankly, some of them don't even look like Americans to me. They look like delusional misfits. We’re going to tax the bad decisions and when I'm done, we’re going to rename it the Trump Court. It’s going to be a much better name and we’re going to make the Court great again.

Oh, absolutely! A Supreme Court chosen based on unwavering loyalty to political parties instead of any hint of, I don’t know, interpreting laws or the Constitution? What could possibly go wrong? I mean, who needs impartiality when you have party affiliation, right?
So, why even bother pretending we can expect anything but a partisan circus? What a shocker!
