Trump SUpreme court just said that if you had a past criminal record, you could still be held years after being released from custody

The case centered on whether detention without a bond hearing must occur promptly upon an immigrant's release from criminal custody or whether it can happen months or even years later when the individual has resettled into society. The statute says simply that the detention can occur "when the alien is released" from custody.


Quite confusing. Does not state what exactly the Government's argument is and that of the opposing view.

The reader is left to make the connection. Poor for a piece on a Court decision.

Very simple, if you are a legal immigrant aka green card holder and commited a crime (s) and served time in prison that does not absolve you from being deported. For example, you committed a crime in 1994 and served time and was released in 1997. ICE can look for you and deport anytime. wink

5-4 SC decision with dissenting opinion being, if one has served his debt to society why is he still being punished?

Even moral turpitude offences can get you deported.

Writing a bad check is a crime involving moral turpitude and as such it could be considered for purposes of determining whether you have a good moral character. Also, a conviction of writing a bad check can make you deportable under section 237 of the INA.Apr 2, 2014

Preap's lawyers at the American Civil Liberties Union argue that under the government's interpretation of the law, those individuals who could prove to an immigration judge that they pose no flight risk will instead be confined in detention for "months or even years on end.



So they holding you to deport you before you can deport yourself?

Well it says on the Green Card docs.."this privilege may be withdrawn at anytime"..at the behest of the government. do the crime do the time and realize there are other consequences when you are not citizen.

In Canada Immigration will deport you immediately after serving the sentence.

If you are a Canadian Citizen before the crime,
you are ok.

If being a Canadian Citizen and a habitual criminal with a long record, you can be deported.
