This means that a person can be accused and even prosecuted for such crimes many years after the alleged event took place. The reasoning behind this is that trauma, fear, and social stigma often delay victims from coming forward, and the justice system recognizes the need for flexibility in these cases.
In English common law, when the Crown (prosecution) charges someone with a criminal offence, they have a duty to disclose all relevant information to the accused, regardless of whether it helps or hurts the Crown's case. This means the Crown must present evidence related to both sides of the case, not just evidence that supports their claim of guilt.
Therefore, the Crown is not just focused on proving the accused's guilt but also on ensuring the accused has all the information necessary to mount an effective defence.
