Barbados to pay for Trini gun dealer’s arrest


The Barbados government has accepted blame for the “forcible removal” of gun dealer Brent Thomas from his hotel room on the Caribbean island by its police force in 2022. In a letter obtained by Newsday, the attorney for Barbados’ Attorney General Dale Marshall, SC, said the island’s government had accepted liability on his advice. “I have advised my client that the State of Barbados should accept liability in respect of the claim for breach of section 18 of the Constitution of Barbados,” Roger Forde, KC, informed Thomas. The parties are locked in negotiations on an agreed settlement which is likely to be substantial.

Thomas initiated legal action seeking compensation for the “egregious conduct” of the Barbadian authorities as well as several declarations relating to his “arrest, detention and forced repatriation” by the Barbados Police Service. He demanded to know who gave the directive which led to his “unlawful abduction” from a hotel room in Barbados on October 5, 2022, as stated by Justice Devindra Rampersad in his ruling on Thomas’ constitutional challenge in April 2023.In November 2022, Thomas filed a constitutional claim against the State and sued over the criminal charges against him. The latter were stayed by Rampersad who condemned the police officers, both locally and from Barbados, for their method of capturing and bringing Thomas back to TT. The State had also admitted that Thomas’ return to TT was unlawful but has appealed aspects of Rampersad’s ruling. The appeal will be heard towards the end of July.

Thomas’s legal team wants the names and ranks of the members of the TTPS, or any other party, who made the request and who contacted Caricom IMPACS (the Implementation Agency for Crime and Security), a special law enforcement agency of Caricom; the names and/or ranks or designation of the persons (from Barbados) who received this information from members of the TTPS, or any other party; the names and/or ranks of persons of the members of the TTPS, or any other party, who interacted with members of the BPS. He also wants the names of the ministers from TT and Barbados who interacted with each other as well as copies of all correspondence and written communication exchanged between them as well as with any public official or police officer, including those from IMPACS.By then he had spent several hours in the “cage” exposed to the sunlight, and sweltering heat and was not given any food or water. Around midday, he was taken to Grantley Adams International Airport, where he was “pushed violently” into an “extremely small plane” and brought back to Trinidad.

In their pre-action letter, Thomas’ attorneys said the inhumane conditions he was detained in Barbados caused him emotional trauma, anguish and immediate fear and anxiety for his life.

Mr Brent Thomas notified authorities that he was going to see his Cardiologist landed in Barbados on way to the USA.

Rowley , Hinds or AG claim to know nothing about how a military plane left Piarco flew to Barbados.
Brent Thomas was arrested in his hotel room with out a warrant.
Barbados’ Attorney General Dale Marshall and PM Mia said they knew nothing about this.
Plane landed in T&T with Thomas as prisoner.

How can such occur when both T&T and Barbadian Police be involved, interesting days lie ahead.

In an address to the Barbadian Parliament on May 9, 2023, Marshall insisted Thomas was not “abducted” from Barbados, but he did admit officers of the BDS had “fallen short of the law” during the operation.He said neither himself nor Prime Minister Mia Mottley was informed or made aware of any matter involving Thomas, but said that was not unusual. “We simply had no knowledge nor involvement in this matter.

Griffith: Those involved in Brent Thomas arrest will be revealed


"The Barbados Government's admission of guilt in the Brent Thomas “abduction” will now reveal the Trinidad and Tobago Government Minister who authorized the arrest."

This is according to former National Security Minister and Leader of the NTA, Gary Griffith. In a statement on Sunday, Griffith said "the names of a TT Minister or Ministers involved in the incident, and their correspondence" are set to be revealed after the Barbados Government accepted liability and agreed to pay Brent Thomas damages for their part in his arrest.

He went further in stating he wrote to the Police Complaints Authority (PCA), and after the Minister's name is revealed, "I will write to the PCA again, as well as the Police Service Commission (PolSC), should Commissioner Harewood-Christopher fail to adhere to her responsibility to have this matter thoroughly investigated."

Gary to write PCA, Police Commission on Brent Thomas fiasco

Former Commissioner of Police Gary Griffith claims that the truth about the Government’s involvement in the controversial 2022 arrest of Brent Thomas in Barbados will soon be revealed after the Barbados government accepted liability for breaching Thomas’s constitutional rights. He said he intends to write to the PCA and the Police Service Commission on the matter if need be. Thomas, a firearms dealer, was arrested in Barbados and brought back to this country resulting in a cross-border furore which led to probes in both Barbados and T&T.

In a statement issued by his party the National Transformation Alliance yesterday, Griffith said the citizens of Trinidad and Tobago will “soon face another example of a blatant lie, which shows how deceptive, immoral and unethical the government is.” “I call on the Commissioner of Police to do her job without fear or favour, and I urge the government to immediately come clean and fire the Minister and other officials involved, so as to show some respect to citizens who deserve the truth and who must be guaranteed that no one is untouchable.”

“I also wrote to the Police Complaints Authority (PCA), and after the Minister’s name is revealed, I will write to the PCA again, as well as the Police Service Commission (PolSC), should Commissioner (Erla) Harewood-Christopher fail to adhere to her responsibility to have this matter thoroughly investigated,” the National Transformation Alliance political leader said. T&T AG Armour on Brent Thomas twist: Barbados acting in its interest

After it was revealed that the Barbados government has accepted liability in the Brent Thomas matter, Attorney General Reginald Armour says he has every confidence that the Attorney General of Barbados Dale Marshall SC, is acting in the best interest of his country. However, Armour said, he has no intention of offering an opinion on the matter.

“I have noted the statements in the media attributed to Barbados AG Dale Marshall SC. I trust that his actions are based on the information at his disposal and the guidance of legal counsel,” AG Armour said on Monday in response to questions from Guardian Media, following the revelation that Barbados has accepted legal liability in Thomas' lawsuit against the state.

Armour clarified that the decision by the Barbados government to accept liability has no impact on the matter involving Trinidad and Tobago’s government.
“The matter involving the State (GORTT) is currently before the Courts of Trinidad and Tobago, is sub judicé and as such, it is prohibited from public discussion or comment,” he said.
